Course Overview 

The programme is designed to deliver high-level practical knowledge and insights into Competition Law as applicable in Cyprus by providing an overview of some fundamental aspects of Competition law. It will strive to enhance participants’ knowledge and ability to identify competition issues in their daily practice and transactions either as external counsel or within their own organisation. The course will also enhance the ability of the participants to define legal strategies and to assess competition law risk, an area that in recent years is receiving increased regulatory attention and more enforcement action.

 

Training Objectives

By the end of the programme, participants should have an understanding of:

  • Key terms and concepts within competition law as it applies in Cyprus;
  • The coverage of the main substantive competition rules with focus on anticompetitive agreements, abuse of market power and the need to notify certain transaction to the Commission for the Protection of Competition of the Republic of Cyprus
  • The different legal frameworks by which competition law is enforced (public and private enforcement) and the implications that arise under each.

Training Outline

  • Key Competition Law terms and concepts:
      • Policy and economic considerations
      • EU and Cypriot legislative framework
      • Definition of relevant market and assessment of market power
  • Vertical vs horizontal relationships The different legal frameworks by which competition law is enforced in Cyprus (public vs private enforcement) and the implications that arise under each (legal consequences and sanctions).
  • Overview of Main Substantive Rules I: Anticompetitive agreements and relevance of competition law to commercial agreements:
      • Cartels and tacit collusion
      • Information exchange
      • Rules applicable to vertical and horizontal agreements (e.g dealing with competitors, supply and distribution agreements)
  • Overview of Main Substantive Rules II: Prohibition of abuse of a dominant position / abuse of economic dependence
  • Overview of Main Substantive Rules III: Relevance of competition law to M&As and Joint Ventures: need to notify certain transaction of major importance to the Commission for the Protection of Competition of the Republic of Cyprus
  • Overview of investigatory powers of the Commission for the Protection of Competition / On -site inspections and Requests for Information
  • Key Take aways: Need for a Compliance program?

Training Style

This programme may be approved for up to 2 CPD units in Law. Eligibility criteria and CPD Units are verified directly by your association, regulator or other bodies which you hold membership.
